Hyyat Host General Terms of Service

The framework for your relationship with Hyyat Host across every service: your account, payments, communication, liability and disputes. Each service has its own agreement that completes these terms.

Who we are and scope

In short:These terms are the umbrella; each service agreement adds its details.

  1. 1.1Hyyat Host is a brand providing web hosting, domain registration, servers, and website design and development, based in Riyadh, Saudi Arabia. In these documents it is called "Hyyat Host" or "we", and the account holder is called "the client" or "you".
  2. 1.2These terms apply to every service and product you order from Hyyat Host, through hyyat.com, the client area at hyyatdomain.com or any official channel of ours.
  3. 1.3These terms are completed by the following documents, which together form one agreement: the Acceptable Use Policy, the Fair Use Policy, the Refund and Cancellation Policy, the Privacy Policy, and the agreement for the service you order: hosting, domains, servers or design and programming.
  4. 1.4In case of conflict, the order of precedence is: a signed written agreement for a specific project or service, then the service agreement, then these general terms, then the policies.

Acceptance and eligibility

In short:Ordering or using a service means you accept the terms, and you must be able to contract.

  1. 2.1Completing an order, paying an invoice or using a service counts as acceptance of these terms in the version published at that time.
  2. 2.2The client must be at least 18 and legally able to contract. If you order on behalf of an organization, you confirm you are authorized to bind it to these terms.
  3. 2.3If you do not agree with any of these terms, do not order or use the service.

Your account, data and security

In short:Your details must be correct and current, and you are responsible for protecting your login.

  1. 3.1You must provide correct and complete details when registering, including name, email, mobile number and address, and update them when they change. Invoices and alerts are sent to them.
  2. 3.2We may request proof of identity or of payment-method ownership when in doubt, and hold activation until verification is complete.
  3. 3.3You are responsible for keeping your account and service passwords confidential, and for everything done with them. We recommend enabling two-factor authentication where available.
  4. 3.4Tell us immediately via a ticket about any unauthorized use of your account. We are not liable for damage caused by your disclosure or careless handling of your login details.
  5. 3.5The registered account holder is the recognized owner of the services linked to the account. We handle account requests only with them or with someone they authorize in writing through the account.

Communication and official channels

In short:Official requests by ticket, questions by WhatsApp, notices to your registered email.

  1. 4.1Support tickets in the client area are the official channel for technical support, billing, cancellation, refunds and any request that needs a record.
  2. 4.2WhatsApp and other channels are for questions, sales and follow-up. Anything agreed there becomes binding once confirmed by a ticket or an invoice.
  3. 4.3We send official notices (invoices, alerts, changes to terms and suspension notices) to the email registered in your account, and they are considered received once sent there.
  4. 4.4Tasks that need a person (such as confirming manual payments or manual activation) are handled during official working hours; anything arriving outside them or on official holidays is handled on the next working day.
  5. 4.5We expect respectful dealings with our team. Repeated abuse or threats justify ending the relationship under the termination terms.

Prices, invoices and payment

In short:You pay in advance for each term, at the price shown on the service page when you order.

  1. 5.1Prices are shown in US dollars; amounts in Saudi riyals are approximate, at the exchange rate in the client area when the invoice is issued.
  2. 5.2Services are paid in advance for the chosen billing term (monthly, yearly or other, depending on the service), and are not activated before payment is confirmed unless stated otherwise.
  3. 5.3Payments by Mada, Visa and Mastercard are usually confirmed automatically; some payments need manual confirmation by our accounts team during working hours.
  4. 5.4Renewal invoices are issued before the due date, with timing that varies by service. Each service agreement sets the suspension and deletion dates for non-payment.
  5. 5.5We may change service prices; changes apply from the next renewal after we notify you and never affect a period already paid for.
  6. 5.6A payment is not complete if it is reversed or charged back. In that case we may suspend the related services until the amount is settled.

Handling fees

In short:Clear, limited fees for extra work caused by an account, instead of open-ended penalties.

  1. 6.1Some extra work caused by an account has published handling fees, and we tell you before doing it whenever possible:
  2. 6.2Removing an IP address from blacklists when the listing was caused by activity from the client's account: USD 50 per case.
  3. 6.3Extracting a backup larger than 1 GB at the client's request: based on size and effort, after you approve the amount.
  4. 6.4Manual migration of sites from our servers to another provider, or support for client software outside the service scope: by prior quote that you approve.
  5. 6.5We charge no fees or penalties other than those listed here, in the service agreement or on its page.

Suspension

In short:As a rule we notify you and give you time; immediate suspension is for serious cases only.

  1. 7.1When terms or policies are breached, we send a notice explaining the issue with a reasonable period to fix it, then suspend the service if it is not fixed.
  2. 7.2We may suspend immediately without prior notice in serious cases: malware, phishing, spam, denial-of-service attacks, unlawful content, anything threatening the server or other clients, or at an official request. We notify you right after.
  3. 7.3The suspension is lifted once the cause is fixed and any dues are paid.
  4. 7.4A suspension neither pauses nor extends the subscription term.

Content and intellectual property

In short:Your content is yours and your responsibility; our site content is ours.

  1. 8.1Everything you upload or store on our services, including text, images, data and software, remains yours, and you alone are responsible for its legality and for others' rights in it.
  2. 8.2You grant us a limited right to store, copy and move your content only as needed to provide the service, such as taking backups and migrating sites.
  3. 8.3The content, designs, logos and text of the Hyyat Host website belong to Hyyat Host and may not be copied or used without written permission.
  4. 8.4We do not review client content in advance, but we may block or remove any content that breaches the Acceptable Use Policy or the law.

Warranty limits

In short:We apply full professional care, but no online service is completely free of interruptions.

  1. 9.1We provide our services with ordinary professional care and work to keep them available, stable and secure.
  2. 9.2We do not guarantee that a service will be entirely free of interruptions or errors, or fit a particular purpose not agreed in writing.
  3. 9.3We do not guarantee third-party services that we resell or rely on (such as domain registries, data centers and license providers), and we follow up with them on your behalf.
  4. 9.4Software and scripts offered in control panels are provided as released by their makers, and their programming support comes from those sources.

Limitation of liability

In short:Our liability is capped at what you paid, and excludes indirect losses.

  1. 10.1Hyyat Host is not liable for indirect or consequential damages, including loss of profit, loss of data, business interruption or reputational harm, whatever the cause.
  2. 10.2In all cases, Hyyat Host's total liability for any claim does not exceed what the client actually paid for the affected service during the three months before the claim.
  3. 10.3The client alone is responsible for keeping independent backups of their data and content. Any backups we take are an extra help and do not transfer responsibility for your data to us.
  4. 10.4These limits do not exclude liability that cannot legally be limited, such as fraud or deliberate gross misconduct.

Indemnity

In short:If your breach leads to a claim against us, you bear its consequences.

  1. 11.1The client shall indemnify Hyyat Host and its staff against any claim, lawsuit, fine or reasonable cost, including legal fees, arising from the client's content, use of the service, or breach of these terms or the law.
  2. 11.2We will notify you of any such claim as soon as we learn of it and cooperate with you reasonably.

Force majeure

In short:Neither party is held responsible for events beyond its control.

  1. 12.1Neither party is in breach if performance is delayed or prevented by circumstances beyond its control, such as natural disasters, fires, power or public network outages, large-scale cyberattacks, failures of data centers or service providers, and government decisions.
  2. 12.2The affected party must notify the other and make reasonable efforts to limit the impact and resume performance as soon as possible.

Changes to the terms

In short:No sudden changes: we notify you 14 days ahead.

  1. 13.1Hyyat Host may amend these terms or any agreement or policy, and publishes each new version with its date, number and change log.
  2. 13.2We email notice of material changes to your registered address at least 14 days before they take effect. Continuing to use the service afterwards counts as acceptance, and before they take effect you may cancel under the Refund and Cancellation Policy.
  3. 13.3Changes required by law, official authorities or domain registries take effect from their effective date.

Governing law and disputes

In short:We start with an amicable solution, then the courts of Riyadh.

  1. 14.1These terms and all related agreements and policies are governed by and interpreted under the laws of the Kingdom of Saudi Arabia.
  2. 14.2Both parties will try to resolve any dispute amicably through an official ticket, which we answer within 15 days.
  3. 14.3If an amicable solution is not reached, the courts of Riyadh have jurisdiction over the dispute.

General provisions

In short:Clauses that keep the agreement coherent.

  1. 15.1If any clause is invalid or unenforceable, the rest remain in force, and the invalid clause is applied in the closest lawful form that achieves its purpose.
  2. 15.2Failure by either party to enforce a right at any time does not waive it.
  3. 15.3The client may not assign a service or account to another person except by request through a ticket and with our approval; ownership transfers once the new owner's details are updated.
  4. 15.4These terms do not create a partnership, agency or employment relationship between the parties.
  5. 15.5The Arabic text prevails over any translation.

What is the official channel for my requests?

Support tickets in the client area are the official channel for support, billing, cancellation and refunds. WhatsApp is for questions and sales, and anything agreed there is confirmed by a ticket or an invoice.

Can my service be suspended without notice?

As a rule we notify you and give you time to fix the issue. Immediate suspension is only for serious cases such as malware, phishing, spam and attacks, or official orders, and we notify you right after.

Are there penalties?

There are no open-ended penalties. There are limited, published handling fees, such as USD 50 to remove an IP from blacklists due to activity from your account, and any other extra work by a quote you approve first.

How will I know about changes to the terms?

We email your registered address at least 14 days before any material change takes effect, and publish the version number, date and change log at the bottom of each document.

What is Hyyat Host's liability limit?

It does not exceed what you paid for the affected service in the previous three months, and excludes indirect damages and data loss. That is why we always advise keeping an independent backup.
