Scope and parties

In short:We act between you and the registry.

  1. 1.1This agreement applies to the domain registration, renewal, transfer and management services provided by Hyyat Host.
  2. 1.2Hyyat Host provides the service with accredited registrars and with the registries that manage each extension, including ICANN for generic domains and the Saudi Network Information Center for the Saudi domain.
  3. 1.3By registering a domain, you also agree to the policies of the registrar and the relevant extension's registry, as amended from time to time.
  4. 1.4This agreement is completed by the General Terms, the Refund and Cancellation Policy and the Privacy Policy.
2

Registration and data

In short:Availability is not a guarantee, and your details must be correct.

  1. 2.1A domain showing as available in a search does not guarantee its registration; registration is complete only once the registry confirms it. If it cannot be registered, we refund in full.
  2. 2.2You must provide correct and complete details for the domain owner and contacts (name, address, email and phone), and update them when they change. Wrong details may lead the registry to suspend or cancel the domain.
  3. 2.3Registries may require email or data verification, and failing to verify within the deadline may suspend the domain.
  4. 2.4The registrant is the person recorded as owner in the registry, even if someone else paid for or manages the domain.
  5. 2.5You confirm that the domain does not infringe others' rights or trademarks and is not used for a purpose contrary to the law or Islamic law.
3

Saudi domains (.sa)

In short:They have their own rules and documents.

  1. 3.1Registration of Saudi domains (.sa, .com.sa, .net.sa, .org.sa and others) follows the rules of the Saudi Network Information Center.
  2. 3.2Some extensions require documents, such as a commercial registration or proof of status, and registration is complete once the center approves them.
  3. 3.3The review time and the decision to accept or reject belong to the center; we follow up with you and report the outcome.
4

Fees

In short:Paid in advance and non-refundable.

  1. 4.1Registration, renewal and transfer fees are paid in advance, before processing.
  2. 4.2Domain fees are non-refundable once registered, renewed or transferred, even if the domain is cancelled, transferred or suspended before the end of its term, as they are paid to the registry immediately.
  3. 4.3Renewal prices may differ from the first registration price and are shown on the domains page and on the renewal invoice.
5

Renewal and expiry

In short:Renewal is your responsibility; we remind you before the date.

  1. 5.1Renewing the domain on time is the client's responsibility. We send email reminders before expiry, and not receiving them does not remove that responsibility.
  2. 5.2After a domain expires without renewal, it stops working (website and email) and passes through periods set by the registry for each extension: a renewal grace period, then a redemption period with a higher fee, then it becomes available for anyone to register.
  3. 5.3Recovering a domain after expiry is not guaranteed, and its fees are set by the registry. We are not responsible for losing a domain that was not renewed on time.
6

Transfers and change of owner

In short:The auth code comes from you; the 60-day lock comes from the registry.

  1. 6.1To transfer a domain to or from us, you need the auth code, and the domain must be unlocked and active.
  2. 6.2Registries may block a transfer within 60 days of registration, transfer or change of owner details.
  3. 6.3We provide the auth code when the account holder requests it through a ticket, provided there are no dues or disputes on the domain.
  4. 6.4Changing the domain owner is done at the request of the current account holder, and the new owner is bound by this agreement. We are not responsible for the results of a mistaken transfer or of losing access to the registered email.
7

Privacy and WHOIS data

In short:Some of your details may appear in domain records.

  1. 7.1Registries require collecting the details of the domain owner and contacts, and some may appear in public WHOIS databases according to the extension's policy.
  2. 7.2We offer WHOIS privacy protection for extensions that support it; it is not available for all extensions, including the Saudi domain.
  3. 7.3How we handle your data is explained in the Privacy Policy.
8

Disputes and suspension

In short:Domain disputes follow their international and Saudi policies.

  1. 8.1Disputes over generic domains follow ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP), and disputes over Saudi domains follow the Saudi Network Information Center's policy.
  2. 8.2The registry or official authorities may suspend, cancel or transfer a domain under their policies or by legal order, and we comply.
  3. 8.3We may suspend a domain used for spam, malware or phishing, under the Acceptable Use Policy.
9

Limitation of liability

In short:Capped at the domain fee.

  1. 9.1Hyyat Host's liability for any domain does not exceed its latest registration or renewal fee.
  2. 9.2We are not responsible for registry decisions or outages, or for losing a domain due to non-renewal, wrong details or a dispute with others.
